ATF Firearms Export Form 9 Revision

The Justice Depaertment's Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) will be submitting for review and approval revisions to the form filed for approval to permanently export NFA firearms registered in the National Firearms Registration and Transfer Record

ATF Form 9 (5320.9) is typically used by a Federal firearms licensee who has paid the special (occupational) tax to deal, manufacture or import NFA firearms. The form must be filed (in quadruplicate) for approval to permanently export NFA firearms registered in the National Firearms Registration and Transfer Record. Once authorization has been granted, one copy is retained by ATF and the remaining copies returned to the exporter to establish that the exportation took place.

The information collection (IC) OMB 1140-0008 (Application and Permit for Permanent Exportation of Firearms – ATF Form 9 (5320.9) is being revised to change the last sentence in ‘Instructions 1a’. This change includes deleting “to that effect” and adding “certifying compliance with 26 U.S. Code § 5854 and 27 CFR § 479.33”.

The proposed information collection was previously published in the Federal Register, volume 89 page 15614, on Monday, March 4, 2024, allowing a 60-day comment period.
