BIS Expedites Israel Licesnes

US Department of Commerce appears to be establishing an expedited route for export licenses for Israel.

Exports must comply with the International Traffic in Arms Regulations (ITAR) or the EAR Commerce Control List.

Expedited procedures are possible under ITAR but have yet to be implemented by the State Department. ITAR Part 126 (General Policies and Provisions) provides the authority for the State Department to waive established export licensing procedures and requirements; thereby implementing a fast-track license approval process if in the interest of U.S. national security, foreign policy or otherwise in the interest of the U.S. Government

The Commerce Department appears to be considering a fast-track system, posting on their website: "Submit your Israel licensing requests here: IsraelEmergencyLicense@bis.doc.gov".

Is the Bureau of Industry and Security (BIS) able to expedite license applications for the export/reexport of items subject to the Export Administration Regulations (EAR) needed by Israel?

Yes. Working with our interagency partners, BIS can expedite license applications for items needed by the government, military, and security forces of Israel. To enable BIS to do so, exporters/reexporters must provide full identifying information on the consignee/end user of the items, to include identifying a point of contact. Once a license application is successfully submitted through the SNAP-R system, exporters/reexporters must email the Application Control Number (“Z” Number) to: IsraelEmergencyLicense@bis.doc.gov along with a thorough explanation of the need for expedited processing.

For export control purposes, the Palestinian territories of Gaza and the West Bank are not recognized as a destination separate and distinct from Israel. If a license is required for an export/reexport to Israel, then a license is required for an export/reexport to the Palestinian territories of Gaza and the West Bank.

ISRAEL EXPORT CONTROL INFORMATION

Although Israel is not a member of the Australia Group, Missile Technology Control Regime, Nuclear Suppliers Group, or Wassenaar Arrangement  , Israel implements controls in line with these regimes and requires authorization for exports of all items listed on their control lists.

The Israeli licensing authority for Missile Technology Control Regime items, Wassenaar Munitions List items, and certain Wassenaar Dual-Use List items destined for military end uses or end users is the Defense Export Control Agency (DECA).
