The fight over refunds from the now-invalidated IEEPA tariffs has a clear historical parallel: the Harbor Maintenance Tax litigation of the late 1990s. Then, as now, a Supreme Court ruling striking down a federal trade-related levy did not end the controversy but began a prolonged battle over refunds, eligibility, deadlines, and administrative process. That earlier episode shows that even after the courts settle the legality of a tariff or tax, importers and the government can remain mired for years in disputes over how unlawfully collected money is returned.
