On September 18, U.S. Customs and Border Protection (CBP) updated the Withhold Release Order (WRO) issued against Supermax Corporation Bhd. and its subsidiaries following the remediation of forced labor indicators in the company's supply chain. Effective immediately, CBP will permit the entry of disposable gloves produced by these entities into the U.S. if compliant with U.S. laws.
The initial WRO was based on evidence indicating the presence of 10 out of 11 International Labour Organization markers of forced labor. Supermax Corporation Bhd. showcased efforts to amend these issues within its supply chain to the CBP.
The modification marks the fourth of its kind in fiscal year 2023, part of CBP's continuous effort to eliminate forced labor from supply chains, enhancing the ethical standard of goods entering the U.S. The efforts have reportedly ameliorated living and working conditions for tens of thousands of workers globally.
Under 19 U.S.C. § 1307, the importation of goods produced using forced or indentured labor, including child labor, is prohibited. CBP detains shipments suspected to be in violation, with potential exclusion, seizure, and forfeiture if proof of compliance is not provided by the importer. CBP manages a process for the request of WRO or Finding modifications or revocations, contingent upon evidence proving the cessation of forced labor use in the production of the concerned merchandise.
