Solar Import Duties to 3,521%

The U.S. Department of Commerce has concluded its investigation into solar panel imports from Cambodia, Malaysia, Thailand, and Vietnam, determining that these imports were sold below fair market value and benefited from unfair subsidies. As a result, the Department has imposed antidumping and countervailing duties, with rates varying by country and company.

Cambodian producers, having not cooperated with the investigation, face the steepest combined duties, reaching up to 3,521%. In Malaysia, Jinko Solar’s products are subject to a combined rate of 41.56%. Trina Solar’s products from Thailand are assessed at 375.19%. Vietnamese producers such as JA Solar and Jinko Solar Vietnam face combined rates ranging from approximately 120% to over 245% .

These measures are pending a final determination by the U.S. International Trade Commission (ITC), expected by June 2, 2025. If the ITC confirms that the U.S. industry has been materially harmed by these imports, the duties will become permanent.

The American Alliance for Solar Manufacturing Trade Committee, which includes companies like First Solar and Hanwha Qcells, initiated the case, alleging that Chinese-owned firms were circumventing existing tariffs by manufacturing in Southeast Asia. Tim Brightbill, the coalition’s lead counsel, stated, “These are very strong results… We are confident that they will address the unfair trade practices… which have been injuring the U.S. solar manufacturing industry for far too long” .

Critics, including the Solar Energy Industries Association, argue that the tariffs could increase costs for U.S. solar producers reliant on imported components, potentially hindering the growth of domestic solar manufacturing .
